Most patents are applied for inventions that are derived from terrestrial biotechnology. However, it is recognized that marine biotechnology offers a high potential to yield inventions as well. Marine biotechnology can be divided into two main areas. First, development of commercially viable drugs obtained from marine bioprospecting and, second, development of marine genetically modified organisms for aquacultural and environmental purposes. A patent means intellectual protection for an invention. Intellectual protection confers the exclusive right upon the patent holder to sell the right of utilization of the invention to interested parties. The selling of licenses provide one important way of receiving revenues for the research done for the invention. The prospect of potential revenues provide the incentive for investment into biotechnological research and subsequent patenting of inventions arising thereof. The overall aim of this work is to illustrate the close interrelationship of science and law by using marine biotechnology and patents as an example. Section two provides an overview on the scientific side of marine biotechnology. It will define marine biotechnology and investigate current advancements in marine biotechnology. Additionally, it roughly explains the international patent system governing inventions in the biotechnological area and provide examples on patents related to marine biotechnology. Section three illustrates the criticism expressed against life form patents in marine as well as terrestrial biotechnology. Dramatic developments in understanding the fundamental underpinnings of life have provided exciting opportunities to make marine bioproducts an important part of the U.S. economy. Several marine based pharmaceuticals are under active commercial development, ecosystem health is high on the public's list of concerns, and aquaculture is providing an ever greater proportion of the seafood on our tables. Nevertheless, marine biotechnology has not yet caught the public's, or investor's, attention. Two workshops, held in October 1999 and November 2001 at the National Academies, were successful in highlighting new developments and opportunities in environmental and biomedical applications of marine biotechnology, and also in identifying factors that are impeding commercial exploitation of these products. This report includes a synthesis of the 2001 sessions addressing drug discovery and development, applications of genomics and proteomics to marine biotechnology, biomaterials and bioengineering, and public policy and essays contributed by the workshop speakers.

In 1966 Congress passed the National Sea Grant College Program Act to promote marine research, education, and extension services in institutions along the nation's ocean and Great Lakes coasts. In Maryland a Sea Grant Program -- a partnership among federal and state governments, universities, and industries -- began in 1977, and in 1982 the University of Maryland was named the nation's seventeenth Sea Grant College.The Maryland Sea Grant College focuses its efforts on the Chesapeake Bay, with emphasis on the marine concerns of fisheries, seafood technology, and environmental quality.This report addresses the emerging science and developing technologies encompassed by marine biotechnology. Many of these substances show potential biomedical applications, which could lead to development of new pharmaceutical products. Research on the utilization of natural products from marine organisms is growing by leaps and bounds; one important reason why being that, investigators, through new diving technologies, are becoming able to explore at greater depths.
