'Copyright is increasingly broad in scope and the range of perspectives that can be applied to study it is equally wide not just IP law but legal philosophy, economics, cultural studies, ethnography, legal history and political science are all potentially relevant approaches to dissecting the copyright octopus. This book includes examples of all these approaches. It makes fascinating reading. It is also a valuable contribution to the current debate about the future development of copyright law.'

This book sets out to expose, analyse and evaluate the conflicting conceptions of legal judgment that operate in intellectual property law. Its central theme is the opposition between law-making by way of the creation of generally applicable rules and law-making done at the point of application through case-by- case decisions tailored to the particulars of individual circumstances. Through an exploration of form, the analysis sets out to provide insights into how intellectual property law achieves a balance between various competing interests.

Intellectual property law in Australia has changed dramatically in the last decade and continues to change. Developments in technology, the rise of the internet, the globalisation of trade and the increasing importance of 'superbrands' – trade marks with global appeal – have all affected the laws surrounding intellectual property. Furthermore, globalisation has resulted in greater pressure on intellectual property owners to expand their rights as they endeavour to capture the potential benefits of ownership in an increasingly affluent and integrated world economy. Australian Intellectual Property Law, 2nd edition has been fully revised to take into account these significant case and legislative developments in trademarks, copyright and patents law. This book offers students and legal professionals a detailed discussion of the black-letter aspects of the law, with a primary emphasis on legal principles and complexities.

Among the many contentious matters thrown up by the relentless march of economic globalization, those forms of knowledge variously known as 'indigenous' or 'traditional' remain seriously threatened, despite numerous transnational initiatives and highly publicized debate. It is not proving easy to bring these holistic worldviews into accordance with the technical terms and classifications of intellectual property law. The contributions in this volume contrast efforts to find solutions and workable models at the international and regional level with experiences on the ground. Legal policies related to 'indigenous knowledge' in settler societies such as Australia and New Zealand are compared with those in densely populated neighbouring countries in Asia, where traditional knowledge is often regarded as national heritage. While many of the chapters are written by lawyers using an interdisciplinary approach, other chapters introduce the reader to perspectives from disciplines such as legal sociology and anthropology on controversial issues such as the understandings of 'art, ' 'culture, ' 'tradition, ' 'customary law' and the opportunities for traditional cultural knowledge and traditional cultural expressions in an Internet environment. Experienced observers of the international debate and regional experts discuss international model laws as well as legislation at regional and national level and the role of customary law. Topics covered include the following and much more: the concept of 'farmers' rights'; biodiscovery and bioprospecting; traditional knowledge as a commodity; encounters between different legalities; geographical indications; registration requirements; sanctions, remedies, and dispute resolution mechanisms; the ongoing fragmentation and loss of traditional knowledge; and systems of data collection.

Do your students struggle to engage with legal topics? Look no further than Marson and Ferris' Business Law to help them actively engage with the law, understand it, and approach it with confidence.Written with business, management, and finance and accounting students in mind, the authors put the law into a context that they can easily understand by introducing case studies in every chapter. "Business Scenarios" help the students contextualize the law by presenting the reader with an exampleof an everyday problem which demonstrates how the law can affect a company, employer, employee, or other individual.Throughout each chapter the students are asked to pause and consider how the content applies to these routine business problems, enabling them to become active readers and think independently about how the law operates. The first chapter provides a helpful guide to studying the law and advice on how to excel in assessments so that students can fulfil their potential. This chapter includes a sample problem question and model answer. Further sample problem and essay questions can be found at the end of chapters, giving readers an opportunity to test their understanding and practise for assessments. Students will be able to find indicative answers to these questions hosted with the online resources for this book.At the end of each chapter the authors provide further reading suggestions to guide students that want to deepen their knowledge, including well-maintained and trusted websites, Twitter feeds, and YouTube channels in addition to suitable books and articles.Online resourcesThis book is accompanied by a suite of online resources to support students' learning, including flashcard cases, self-test questions and answers with feedback, and additional material on legislation.
