Despite a decline in traditional rail freight markets (especially coal and steel), and loss of market share to other modes, the overall growth in freight in recent years has allowed rail freight to maintain its volume. The Commission has introduced three packages of directives to stimulate further growth in this market (the first should have been implemented in the 15 member states, the second is to be implemented by 2005, and the third is yet to be adopted). This report reviews the background to the packages, and offers a provisional analysis of their effect so far. The quality of service offered to customers of rail freight movement in Europe falls seriously short of standards required in a competitive environment. Liberalisation of the UK market since 1994 has, however, resulted in better performance and a growing market share for rail freight. The Committee has reservations about some parts of the third package of directives, particularly the proposal to require all train drivers to hold an international rail driving licence, and the proposal for compulsory compensation to rail freight customers for poor quality service. The report also examines problems with the Channel Tunnel, the only direct rail link between the UK and mainland Europe.

When British Railways (BR) was privatised in April 1994 some of the freight companies were bought by English Welsh Scottish Railways (EWSR), which immediately reviewed the mixed locomotive fleet and led to the decision to purchase 250 locomotives from General Motors (USA), based on that company’s earlier Class 59 design supplied to Foster Yeoman in 1985. Delivered to Newport Docks each locomotive was lubricated, filled with fuel and water and released to traffic within hours of being craned onto the quayside. The early privatised freight market was geared to the heavy industries but the changes of Government policies to counteract global warming has seen consequent changes in freight operations whilst global trading has seen massive growth in the movement of containers between ports and inland distribution centres. This changing market has encouraged both existing and new operators to base operations on a reliable locomotive fleet which has been met by the Class 66 design. The expansion of the locomotive’s operating area has been recorded within the book through a regional analysis noting both the freight services operated within the region and the companies providing them. This also notes changes of operators, both by exchange of locomotives and exchange of hauler as contracts are re-negotiated at regular intervals. Fred Kerr’s book seeks to show, as at October 2019, the range of services that have been operated by class members, including the occasional passenger services despite the locomotives not being fitted with any heat generating equipment.

The Transport Committee welcomes record investment committed to the 'classic' rail network but calls for greater regional balance in spending. Network Rail must also regain the confidence of passengers following recent disruption. The Committee calls for the Government to take responsibility for rolling stock, to address general shortages and ensure there will be sufficient trains to run on newly-electrified lines. The Committee also concluded: (i) Record levels of funding show a welcome commitment to ’classic' rail but this should be set in a longer-term strategic plan for the rail network, which ties into a wider transport strategy; (ii) The overrunning Christmas engineering works were unacceptable; (iii) Network Rail must have adequate contingency plans. They must also work with Passenger Focus and train operating companies to improve communication with passengers when engineering works fail; (iv) In the light of the change of status of Network Rail the ORR must reconsider whether fining a public sector body remains an effective means for the regulator to exert control; (v) Greater transparency is essential around rail spending. Criteria used to allocate spending should be published.

House of Commons Committee on Standards Mr Tim Yeo HC 849

This case arises from two articles published by the Sunday Times on 9 June 2013, which detailed the results of a "sting" conducted by two reporters, Ms Heidi Blake and Mr Jonathan Calvert, who posed as representatives of a strategic consultancy recruiting a group of expert consultants to launch a solar technology developer. In their article the reporters alleged that Mr Tim Yeo, the Member for South Suffolk, had "told the reporters he could advocate for their company behind the scenes, introduce them to Ministers and guide them on submitting evidence to his own Committee". Mr Yeo referred himself to the Commissioner, who decided to investigate whether he had breached the rules in that he had: offered to make approaches to Ministers and/or servants of the Crown on behalf of a company in which he expected to have a financial interest; and told the managing director of a company which was a subsidiary of a company in which he had a financial interest what to say when giving evidence to the Select Committee of which he was chair. The Commissioner did not uphold either complaint. The Committee agrees with the Commissioner. Mr Yeo made no improper commitments, despite the tone of the Sunday Times articles, and the energetic attempts of the journalists concerned to draw him into doing so. Media investigations can have a role to play in ensuring high standards of public conduct but in this case Mr Yeo has broken no rules and the only misrepresentation has been that of the journalists themselves

The European Commission s 4th Railway Package

The Transport Committee broadly welcomes the European Commission's 4th Railway Package but believes it focuses too much on liberalising the railway in domestic markets at the expense of important measures to improve cross-border freight and passenger services. The Committee recommends the UK Government should actively negotiate to ensure: joint working between Network Rail and train operators is not prohibited or unduly restricted; metro and light rail systems are not affected by the proposals to separate infrastructure and service operators; the UK's arrangements for letting train franchises are not challenged. In addition, MPs are concerned about: governance arrangements for Eurotunnel; the maximum annual threshold proposed for rail franchises, which could prevent UK companies bidding for work in other EU countries; and the possibility that the EU may become responsible for specifying the content of public transport plans: these should remain the responsibility of national or local governments.
