English summary: Classification societies establish and apply technical standards in relation to the design, construction and supervision of ships. Their principal contracting partners are ship builders and ship owners. Increasingly, classification societies are being faced with damage claims initiated by members of the shipping industry with whom they have not established a contractual relationship. Under German law but in a comparative perspective, Jurgen Basedow and Wolfgang Wurmnest examine such third party claims. They focus in particular on how such claims are affected by limitation of liability clauses agreed upon between the classification society and its contracting partners.

This volume seeks to explore the vast history of international maritime business, focussing on themes of management, finance, and labour. Each essay considers the economics of maritime industries and the factors that influenced decision-making. Their collective purpose is to spotlight relatively neglected areas of international maritime business history, and their richly varied subjects and geographies are primarily unified by this theme, whilst demonstrating the universality of international maritime business. The essays cover the following subjects:- the Norwegian shipbroking firm, Fearnley and Eger; the labour management strategies of nineteenth century London dock companies; the hierarchies of Finnish seagoing in the nineteenth century; twentieth-century Spanish merchant shipping; an examination of Gothenburg's leading shipping companies; an exploration of The Royal Mail's postal contracts and overseas mail service; patterns of ownership and finance in Greek deep-sea steamship fleets; the relationships between banks and industry in interwar Italy; the expansion of Japanese post-war shipbuilding; and a survey of Chinese junk trades.

Because the liability of ship owners is limited, classification societies have been considered as exempt from liability. This book analyses which actions of classification societies may give rise to claims and whether or not the societies can be held liable under English, German or American maritime law. In addition, it develops the fundamental aspects of an international convention on the limitation of the liability of classification societies.

T HIS VOL U M E has been written to describe the business side of a commercial enterprise whose field is the entire civilized world. Historically, the theory and knowledge of shipping management, as distinguished from the practical skills of seaman ship, have been transmitted from one generation to the next by word of mouth. Little has been put on paper, primarily because the finest exponents of the art of steamship management have been too busy with their day-to-day concerns to do so. The "working level" personnel often are superbly competent, but rarely qualify as liter ary craftsmen. It has been my aim, in preparing this analysis of the principles of the "business" of commercial shipping, to describe that which trans pires in the various divisions of a shipowning and operating organi zation. Insofar as possible, the procedures followed in the offices have been described and explained, as well as the underlying prin ciples of management by which their decisions are reached. In the process of learning the principles and practices that are set forth in these pages, I have spent ajoy-filled lifetime in associa tion with ships. It has been my good fortune to work in large and small American steamship offices, to operate a major cargo termi nal, to participate in establishing and putting into effect the policies of a world-girdling American steamship organization, and to teach young men these principles learned from experience as well as from precept.

I. The importance of legal questions related to the sea is obvious to everyone. It is hardly surprising that the subjects that make up international current events illustrate the leading role played by maritime affairs. Indeed, it is no coincidence that three quarters of the earth's surface is covered by oceans. Territorial seas, exclusive economic zones, exploitation of the seabed, fishing, transport, insurance, collision, and pollution raise many unresolved questions. On the other hand, the contrast of this importance with the modest attention that existing periodical publications merit must be underscored. Without undervaluing these publications, there has been a need for some time to create a vehicle of common expression, based on three central tenets: interdisciplinary framework, tendency towards uniform law, and both a theoretical and practical approach. a. A framework of interdisciplinary nature seems to be relevant as it is desirable to overcome the artificial separation between public and private law.

English summary: It is Oliver E. Williamson's theory that people behave rationally to a limited extent only and tend to act in their own interests. He shows how post-contractual problems can arise within the framework of relationship-specific dealings, which are subject to a great deal of environmental uncertainty and require specific investments. In order to cope with these problems, capitalist economic systems provide numerous institutions and coordination mechanisms whose efficiency is examined.Williamson studies economic transactions from an economic, legal and organizational perspective. He differentiates between the individual frequency. In doing so, he assigns the most efficient, i.e. the most cost-effective form of coordination to each type of transaction. The structuring, the monitoring of corporations and issues in antitrust law) as well as highly significant empirical evidence attest to its practical importance.
