This book provides practical solutions for addressing energy efficiency as a clause term within a charter party contract. For this, upon a reflection of the regulatory craft, it analyzes key concepts of case law, and discusses them together with commercial and economic principles. In this way, the book aims at offering a comprehensive, interdisciplinary view of the chartering process, together with a new approach for safeguarding energy efficiency investments. A special emphasis is given to the maritime industry. Here, the newly developed framework, based on game theory, has been successfully applied to demonstrate the importance of including a clause term in contract negotiation to achieve protection against both an uncertain market and an even more challenging shipping environment. The book not only fills a gap in the literature, covering a topic that has been largely neglected to date, yet it offers researchers and practitioners extensive information to change the chartering process radically.

This study provides an in-depth analysis of the Hong Kong Ship Recycling Convention as adopted in May 2009 and a thorough analysis of the overall status quo of ship recycling regulations. It investigates the lack of sufficient ratifications of the Convention from both a legal and an economic perspective. The first part of the study focuses on the history of the Convention’s entry-into-force provision and the rationale behind it. Due to the fact that this provision provides a considerable additional obstacle to the Convention’s becoming legally binding, in the second part the focus of the work shifts to unilateral action in this field. An overview of the legal environment of European ship recycling legislation is followed by an analysis and evaluation of a number of proposals by the European Commission attempting to tackle the problems of current ship recycling procedures. With a particular emphasis on (planned) European measures in this regard, the analysis’ overall message is one of cautious optimism.

This book provides a thorough legal analysis of sovereign indebtedness, examining four typologies of sovereign debt – bilateral debt, multilateral debt, syndicated debt and bonded debt – in relation to three crucial contexts: genesis, restructuring and litigation. Its treatise-style approach makes it possible to capture in a systematic manner a phenomenon characterized by high complexity and unclear boundaries. Though the analysis is mainly conducted on the basis of international law, the breadth of this topical subject has made it necessary to include other sources, such as private international law, domestic law and financial practice; moreover, references are made to international financial relations and international financial history so as to provide a more complete understanding. Although it follows the structure of a continental tractatus, the work strikes a balance between consideration of doctrinal and jurisprudential sources, making it a valuable reference work for scholars and practitioners alike.

The International Handbook of Shipping Finance is a one-stop resource, offering comprehensive reference to theory and practice in the area of shipping finance. In the multibillion dollar international shipping industry, it is important to understand the various issues involved in the finance of the sector. This involves the identification and evaluation of the alternative sources of capital available for financing the ships, including the appraisal and budgeting of shipping investment projects; legal and insurance aspects of ship finance; the financial analysis and modelling of investment projects; mergers and acquisitions; and the commercial and market risk management issues involved. Edited by two leading academics in this area, and with contributions from 25 prominent market practitioners and academics over 16 chapters, this Handbook covers shipping finance and banking, maritime financial management and investments. As such, it includes: shipping markets; asset backed finance; shipbuilding finance; debt finance; public and private equity and debt markets; structured finance; legal aspects and key clauses of ship mortgages; marine insurance; mechanisms for handling defaulted loans; investment appraisal and capital budgeting; financial analysis and investment modelling; business risk management and freight derivatives; and mergers and acquisitions. Thus, the Handbook offers a rigorous understanding of the different aspects of modern shipping finance and maritime financial management and investments, the various characteristics of the available products, the capital needs and requirements, and a clear view on the different financial management strategies through a series of practical examples and applications. Technical where appropriate, but grounded in market reality, this is a “must-have” reference for anyone involved in shipping finance, from bank practitioners and commodity trading houses, to shipbrokers, lawyers and insurance houses as well as to university students studying shipping finance. Container Terminals (CT) operate as central nodes in worldwide hub-and-spoke networks and link ocean-going vessels with smaller feeder vessels as well as with inbound and outbound hinterland transportation systems using road, rail, or inland waterways. The volume of transcontinental container flows has gained appreciably over the last five decades -- throughput figures of CT reached new records, frequently with double-digit annual growth rates. Stimulated by throughput requirements and stronger competition between terminals settled in the same region or serving a similar hinterland, respectively, cost efficiency and throughput capabilities become more and more important. Nowadays, both terminal capacity and costs have to be regarded as key indicators for CT competitiveness. In respect of this steady growth, this handbook focuses on planning activities being aimed at “order of magnitude improvements” in terminal performance and economic viability. On the one hand the book is intended to provide readership with technological and organizational CT basics for strategic planning. On the other hand this book offers methodical assistance for fundamental dimensioning of CT in terms of 'technique', 'organization' or 'man'. The former primarily considers comprehensive information about container handling technologies representing the state of the art for present terminal operations, while the latter refers to methodological support comprising in particular quantitative solutions and modeling techniques for strategic terminal decisions as well as straightforward design guidelines. The handbook includes an introductory contribution which gives an overview of strategic planning problems at CT and introduces the contributions of the volume with regard to their relationship in this field. Moreover, each paper contains a section or paragraph that describes the impact of findings investigated by the author(s) for problem-solving in long-term planning of CT (as an application domain). The handbook intends to provide solutions and insights that are valuable for both practitioners in industry who need effective planning approaches to overcome problems and weaknesses in terminal design/development and researchers who would like to inform themselves about the state of the art in methodology of strategic terminal planning or be inspired by new ideas. That is to say, the handbook is addressed to terminal planners in practice as well as to students of maritime courses of study and (application oriented) researchers in the maritime field.

International Trust Laws is a wide-ranging comparative guide to the law of trusts across a number of important jurisdictions, with analysis of issues surrounding the creation of trusts, the powers and duties of trustees, mechanisms of control, and the special uses of trusts. The book combines academic rigour and analysis with a practical focus on trusts in the real world, including assets which modern settlors wish to envelop in a trust; liability concerns of trustees; and the governance, command, and control mechanisms which increasingly form the largest feature of trust creation. It also provides valuable background for trust law practitioners, whether they advise on trusts, draft trust documents, or litigate trust-related matters. The new edition has been fully revised and updated to address important developments in case law and legislation, including the UK Supreme Court decision on the "rule in Hastings-Bass" (Pitt and Futter cases), the Privy Council decision on 'reserved powers trusts' (TMSF), decisions on forced heirship issues in Jersey and Guernsey, decisions on 'asset protection trusts' in the US, the Trusts (Amendment N. 5) (Jersey) Law 2012 and Trusts (Amendment N. 6) (Jersey) Law 2013, Hong Kong's Trust Law (Amendment) Ordinance 2013, the Virgin Islands Special Trusts (Amendment) Act 2013 and Trustee (Amendment) Act 2013, Cyprus' International Trusts (Amendment) Law 2012 Cayman Islands, Trusts Law (2011 Revision), and amendments to the trusts law of New Zealand. It also offers new coverage of the retirement, removal, and appointment of trustees, with a special emphasis on trustee indemnity; and the recognition of trusts in non-trust jurisdictions (civil law jurisdictions, Eastern Europe, Islamic countries, and China).

This edited collection brings together a series of interdisciplinary contributions in the field of Information Technology Law. The topics addressed in this book cover a wide range of theoretical and practical legal issues that have been created by cutting-edge Internet technologies, primarily Big Data, the Internet of Things, and Cloud computing. Consideration is also given to more recent technological breakthroughs that are now used to assist, and — at times — substitute for, human work, such as automation, robots, sensors, and algorithms. The chapters presented in this edition address these issues from the perspective of different legal backgrounds. The first part of the book discusses some of the shortcomings that have prompted legislators to carry out reforms with regard to privacy, data protection, and data security. Notably, some of the complexities and salient points with regard to the new European General Data Protection Regulation (EU GDPR) and the new amendments to the Japan’s Personal Information Protection Act (PIPA) have been scrutinized. The second part looks at the vital role of Internet intermediaries (or brokers) for the proper functioning of the globalized electronic market and innovation technologies in general. The third part examines an electronic approach to evidence with an evaluation of how these technologies affect civil and criminal investigations. The authors also explore issues that have emerged in e-commerce, such as Bitcoin and its blockchain network effects. The book aims to explain, systemize and solve some of the lingering legal questions created by the disruptive technological change that characterizes the early twenty-first century.

The handbook examines the GDPR’s scope of application, the organizational and material requirements for data protection, the rights of data subjects, the role of the Supervisory Authorities, enforcement and fines under the GDPR, and national particularities. In addition, it supplies a brief outlook on the legal consequences for seminal data processing areas, such as Cloud Computing, Big Data and the Internet of Things.Adopted in 2016, the General Data Protection Regulation will come into force in May 2018. It provides for numerous new and intensified data protection obligations, as well as a significant increase in fines (up to 20 million euros). The importance of marine and maritime policy can hardly be overstated in view of the fact that over 90% of world trade is sea-borne and the economic interests of developed, developing and emerging economies alike are all heavily dependent on international trade and commerce. What is perhaps not so readily appreciated by the world community at large including the captains of relevant industries such as shipping, fisheries, cargo and insurance interests, is that environmental issues and concerns are at the very heart of commercial growth and development. This is where the "marine" as distinguished from the "maritime" interests fit into the equation. Both are intimately inter-connected and co-related to the extent that policy development in the field cannot be achieved in a rational manner without the consideration of both these essential factors. This book attempts to bring together both these perspectives through the writings and contributions of several distinguished scholars in their respective fields of expertise. The editor is hopeful that the contributions of these individuals will serve to enhance knowledge and interest in marine and maritime policy development and formulation among those involved in this highly specialised area of endeavour, be they government administrators, private sector executives and managers, practitioners, researchers or scholars of related persuasions. The term "policy" in this book carries a broad connotation referring to both policy that is primarily law based as well as policy formulated on economic and sociological considerations. Marine and maritime business, as a significant commercial activity in the world's economy, is heavily regulated by law. In many areas of marine and maritime affairs, the nexus between legal policy and the policy influenced by market forces as well as their mutual interaction is highly significant, especially viewed from a historical perspective.
